These terms and conditions outline the rules and regulations for the use of Pan-tastique’s website.

By using this website, Pan-tastique assumes you accept these terms and conditions in full. Do not continue to use this website if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this the website and accepting the Company’s terms and conditions. “Pan-tastique”, “The artist”, and “My”, refers to Pan-tastique. “Party”, “Parties”, or “Us”, refers to both the Client and Pan-tastique.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of Pan-tastique’s stated services/products, in accordance with and subject to, prevailing law of The Netherlands. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

These Terms of Service are effective as of May 1st, 2020.

Regarding use of the website

To ensure proper functioning of the Woocommerce store, this website uses cookies. By using Pan-tastique’s website you consent to the use of cookies in accordance with Pan-tastique’s privacy policy. The majority of modern-day interactive websites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of the artist’s affiliate / advertising partners may also use cookies.

Unless otherwise stated, Pan-tastique and/or my licensors own the intellectual property rights for all material on this website. All intellectual property rights are reserved. You may view and/or print pages from http://pan-tastique.com for your own personal use subject to restrictions set in these terms and conditions.

You must not:

This Agreement shall begin on May 1, 2020.

Certain parts of this website offer the opportunity for users to post and exchange opinions, information, material and data (‘Comments/Reviews’) in areas of the the Website. Pan-tastique does not screen, edit, publish or review comments prior to their appearance on the the website. Comments do not reflect the views or opinions of Pan-tastique, my agents, or affiliates. Comments reflect the view and opinion of the person who posts such view or opinion. To the extent permitted by applicable laws, Pan-tastique shall not be responsible or liable for  comments made by other users or for any loss cost, liability, damages or expenses caused and or suffered as a result of any use of and/or posting of and/or appearance of the comments on this website.

Pan-tastique reserves the right to monitor all comments and to remove any comments which it considers in its absolute discretion to be inappropriate, offensive or otherwise in breach of these Terms and Conditions.

You warrant and represent that:

  • You are entitled to post comments and reviews on my website where I allow to do so;
  • Your comments do not infringe any intellectual property right, including without limitation copyright, patent or trademark, or other proprietary right of any third party;
  • Your comments and reviews do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material or material which is an invasion of privacy;
  • Comments and reviews cannot be used to solicit or promote business or custom or present commercial activities or unlawful activity.

By commenting and/or leaving a review, you grant Pan-tastique a non-exclusive royalty-free license to use, reproduce, edit and authorize others to use and reproduce any of your comments in any and all forms, formats or media.

Inappropriate comments and/or reviews using slurs, swearwords, self-promotion tactics or other offensive language will be removed from the website.

The following organizations may link to our The Web site without prior written approval:

  •  Government agencies;
  •  Search engines;
  • News organizations;
  • Online directory distributors when they list us in the directory may link to my website site in the same manner as they hyperlink to the websites of other listed businesses; 
  •  Systemwide Accredited Businesses except soliciting non-profit organizations, charity shopping malls;
  • Any website I am associated with, such as websites related to my work or own Intellectual Properties.

 These organizations may link to our home page, to publications or to other Web site information so long as the link:

  • Is not in any way misleading;
  •  Does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and
  •  Fits within the context of the linking party’s site.

The artist may consider and approve in my sole discretion other link requests from the following types of organizations:

  • commonly-known consumer and/or business information sources such as Chambers of Commerce, American Automobile Association, AARP and Consumers Union;
  •  dot.com community sites;
  •  associations or other groups representing charities, including charity giving sites,
  •  online directory distributors;
  •  internet portals;
  • accounting, law and consulting firms whose primary clients are businesses; 
  • educational institutions and trade associations.

The artist will approve link requests from these organizations if the artist determine that:

  • The link would not reflect unfavourably on me, my associates or my brand accredited businesses (MLMs, pyramid schemes, as well as companies related to certain political ideologies will be rejected);
  • You and your company are in good standing with me and my brand;
  • The benefit to me from the visibility associated with your hyperlink outweighs the absence of my brand; 
  • Where the link is in the context of general resource information, or is otherwise consistent with editorial content in a newsletter or similar product that is in line with my company.

These organizations may link to our home page, to publications or to other website information so long as the link:

  • Is not in any way misleading;
  • Does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and
  •  Fits within the context of the linking party’s site.

If you are among the organizations listed in paragraph 2 above and are interested in linking to my website, you must notify me by sending an e-mail to contact@pan-tastique.com.

Please include your name, your organization name, contact information (such as a phone number and/or e-mail address) as the well as the URL of your site, a list of any URLs from which you intend to link to my website, and a list of the URL(s) on our site to which you would like to link. Allow at least one week for a response.

Approved organizations may hyperlink to my website as follows:

  • By use of our corporate name; or
  • By use of the uniform resource locator (Web address) being linked to; or
  • By use of any other description of our The Web site or material being linked to that makes sense within the context and format of content on the linking party’s site.

No use of Pan-tastique’s logo or other artwork will be allowed for linking absent a trademark license agreement.

Without prior approval and express written permission, you may not create frames around my webpages or use other techniques that alter any way the visual presentation or appearance of my website in any way, shape or form.

The artist reserves the right at any time and in its sole discretion to request that you remove images that belong to me, as well as all links or any particular link to my website. You agree to immediately remove all content that has been requested for removal upon such request. The artist also reserves the right to amend these terms and conditions and its linking policy at any time. By continuing to link to my website, you agree to be bound to and abide by these linking terms and conditions.

If you find any artwork or link on my website objectionable for any reason, you may contact Pan-tastique about this. The artist will consider requests to remove links, but will have no obligation to do so, or to respond directly to you.

Art will only be removed if:

  • It is a portrait of you, commissioned by someone else (e.g. an ex girlfriend who commissioned the two of you together);
  • It contains your Intellectual Property (e.g. Disney can request removal of fanart, and you can request removal of any commission that contains an OC.)

If you request removal of a commission that does not apply to the above, a fee may be charged. 

Whilst the artist endeavours to ensure that the information on my website is correct, the artist does not warrant its completeness or accuracy. Always contact the artist directly regarding commissions.

The artist commits to ensuring that the website remains available and that the material on the website is kept up to date.

The artist claims full liability for any content appearing on this website, but shall have no responsibility or liability for any content appearing as a result from an embed or hyperlink on your website. You agree to indemnify and defend the artist against all claims arising out of or based upon your website. No link(s) may appear on any page on your website, or within any context containing content or materials that may be interpreted as libellous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Pan-tastique is not responsible for any DMCAs that result from you posting a commission or reposting Pan-tastique’s copyrighted content. Pan-tastique will not provide any legal advice.

To the maximum extent permitted by applicable law, the artist excludes all representations, warranties and conditions relating to this website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

  •  limit or exclude our or your liability for death or personal injury resulting from negligence;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;

limit any of our or your liabilities in any way that is not permitted under applicable law; or exclude any of the artist’s or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer:

  • are subject to the preceding paragraph;
  • govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

To the extent that this website and the information and services on this website are provided free of charge, the artist will not be liable for any loss or damage of any nature.

Regarding Commissions - digital

Please note: this section applies to digital commissions only (and merch commissions purchased through e-mail). For merch commissions purchased through my website or regular merchandise purchased here, please refer to the next section(s).

  • Dutch clients have extra payment options compared to international clients.

    All clients will agree to the following terms:

    • Payment must be made on or before the date stated on the invoice, or the artist must be notified of late payment at least a week beforehand.
    • If the client fails to notify about a late payment on time, a 5% fee will apply;
    • Second failed payment of an invoice will add a 10% fee.
    • Third failed payment of an invoice means project cancellation.
    • The artist will cease to work on the project until the client has caught up with their payments.
    • Payment must be made through the billed service.
    • Convention commissions may be paid upfront through cash or card and picked up at the end of the day.
    • Exception: Digital or shipped commissions will be e-mailed to the client or shipped to their home address (shipping charges apply) and may arrive after the convention.
    • Invoices are charged in Euros. No other currency can be accepted at this time; Paypal and Stripe convert the client’s currency to Euros automatically.

The duration of the project will be determined beforehand. Pan-tastique will stick to this given timeframe, but upholds the right to notify the customer of late delivery, given one of the following reasons applies:

  • Irreparable hardware and/or software failure causing the file to be lost or leaving the artist unable to do any further work on the project;
  • Family disaster, such as death or significant illness;
  • Personal illness;
  • School-related delays.

To ensure the project is fulfilled on time, the client promises to:

  • Answer e-mails, calls or texts from the artist in a reasonable time;
  • Give their honest opinion during reviews of the project’s progress;
  • Not ask for any extra work without extra payment and/or extension of the deadline.

In all other cases, Pan-tastique is responsible for the delay and will either:

  • Partially refund the project’s cost (up to 15% in case of a delay);
  • Give a discount for a future project (up to 25%); or
  • Work the extra time required after the deadline for free.

The deadline cannot be moved forward (e.g. from January 10th to January 3rd) by the client upon agreeing on a date, and can only be pushed back (e.g. from January 3rd to January 10th) by the artist after checking with the client.

In short, a commercial use license is a license that allows the client to use the artists’ work in a way that makes them money. 

The following entities must purchase a commercial license:

  • Charities intending to use the artist’s work to raise money
  • Individuals intending to use the artist’s work to sell, advertise, use in YouTube videos, and any other way that is financially profitable to them
  • Companies intending to use the artist’s work in any way that is profitable to them

Pan-tastique offers three types of licenses.

1 – Non-exclusive license

The client:

  • The client receives the right to use the work in one profitable way, predetermined in the agreement;
  • The client must purchase another license to use the work in other ways than mentioned in the agreement;
  • The work commissioned by the client MUST be safe for work;
  • The client cannot edit, reuse or repurpose the work in any way other than agreed to without the artist’s permission;
  • The client must give the artist credit for their work, no matter where it’s used;
  • This license does not expire.

The artist:

  • The artist can add the client’s commission to their public portfolio;
  • The artist cannot sell the client’s commissioned work or any intellectual property featured, but can edit, use and reuse the work in any other way the artist pleases. (Advertising, etc)

2 – Exclusive license

  • The client receives the right to use the work in one profitable way, predetermined in the agreement;
  • The client must purchase another license to use the work in other ways than mentioned in the agreement;
  • The work commissioned by the client MUST be safe for work;
  • The client cannot edit, reuse or repurpose the work in any way other than agreed to without the artist’s permission;
  • The client must give the artist credit for their work, no matter where it’s used;
  • The commercial license does not expire;
  • The exclusivity license lasts as long as agreed upon and must be renewed; the initial license can last up to two years.

The artist:

  • The artist cannot add the client’s commission to their public portfolio for an agreed-upon time, up to two years;
  • The artist cannot sell the client’s commissioned work or any intellectual property featured and cannot edit or reuse the work for an agreed-upon time, up to two years.

3 – Copyright buyout

  • The client receives the right to use the work in any profitable way they see fit;
  • The client does not need to purchase any additional licenses;
  • The work commissioned by the client MUST be safe for work;
  • The client can edit, reuse or repurpose the work in any way they see fit;
  • The client must give the artist credit for their work, no matter where it’s used;
  • The commercial and copyright licenses do not expire;
  • The exclusivity license lasts as long as agreed upon and must be renewed; the initial license can last up to three years.

The artist:

  • The artist cannot add the client’s commission to their public portfolio for an agreed-upon time, up to three years;
  • The artist cannot sell the client’s commissioned work or any intellectual property featured and cannot edit or reuse the work other than to include it, as-is, in the artist’s portfolio or on the artist’s social media.

Optional: Royalties

In some cases, the artist may request royalties rather than, or in addition to, the purchase of a license. These cases entail: 

  • Illustrations for books, magazines or other paper publications that are expected to sell a large volume;
  • Artwork for video games that are expected to sell a large volume.

The client gets special rights in exchange for royalties:

  • Use the artwork in any and all promotial material;
  • Use the artwork in art books, or certain merchandise items.

Client:

  • The client can print their commission to hang it on their wall or gift it
  • The client can use their commission as a background on their devices
  • The client can use their commission as a banner or icon on social media, given the client credits the artist
  • The client can repost their commission on social media, given the client credits the artist
  • The client cannot resell the commission, make prints or merchandise or in any other way make money off the commission
  • The client cannot edit, alter, crop or otherwise change the commission without the artist’s commission (the exception being line-art or sketch commissions, which may be coloured by the CLIENT only)

The artist:

  • The artist can add the client’s commission to their public portfolio;
  • The artist can edit, use and reuse the work in any other way the artist pleases. (Advertising, etc)

If the client’s commission features any of the following, the artist cannot resell it:

  • Names, faces or anything else depicting the client or family members/friends of the client
  • Any commission depiciting real people that do not represent a fictional character (e.g. NOT a portrait of Jennifer Lawrence, but YES a portrait of Katniss Everdeen).
  • Intellectual property belonging to the client.

If the commission features ‘generic’ fanart, the artist may choose to resell it in small numbers. If you do not wish to have your commission resold, please request this and the artist will respect this.

I have received requests before to trace off photos or other artists’ work. I have only one thing to say regarding this:

Under no circumstance, whether it be a commission or a request, will Pan-tastique trace over art or photos for paid work. Poses may be used as reference, but the artist will not use someone else’s work to create his. Please do not make such requests.

The artist will not produce the following pieces with copyrighted characters:

  • A commercial license will never be granted for work featuring copyrighted characters.
  • A commercial license will never be granted work work featuring fan characters.
  • The artist will not draw copyrighted or fan characters in any NSFW depictions.
  • The artist is not responsible for any DMCAs resulting from commissions featuring copyrighted characters that the client may receive. 

Third party means real people. The artist will not draw the following:

  • Real people you are not related to (a spouse or significant other counts as a relation; the artist will not draw ‘lolcows’, or random people in the client’s life); 
  • Real people and/or their original characters OR fan characters which the client doesn’t have permission to use;
  • Celebrity ‘ships’ the client has made up;
  • Clients ‘shipping’ themselves with celebrities.
  • Even if the client knows the third party, they must have permission from the third party for the artist to draw them if it’s a romantically inclined piece. 

I accept ‘NSFW’ commissions, under these conditions:

  • NSFW commissions will not contain my signature, or will be otherwise related to the ‘Pan-tastique’ brand.
  • NSFW commissions will never appear on my website or social media.
  • Do NOT tag or credit Pan-tastique in NSFW commissions. The artist has a separate account intended for that.
  • NSFW commissions always pay the ‘private commission’ fee.

I accept ‘private’ commissions; commissions that are not commercial in nature, but aren’t intended to be shared online. These commissions are charged an extra fee.

General things the artist will and will not accept.

Will accept:

  • Payment through available channels the artist is offering
  • Payment upfront, or partial payment upfront and before delivery
  • ‘NSFW’ artwork commissions
  • Requests to print digital commissions (in exchange for payment)
  • Commissions depicting violence and/or gore
  • Original characters
  • Fan characters
  • Fan art
  • Romantic art

Will not accept:

  • Art depicting and/or supporting racism, sexism, homophobia, slurs, or any other kind of violation of human rights
  • Pornography
  • Any kind of payment after delivery (all payments must be made in full before the client receives the piece)
  • Minors or fictional characters in ‘NSFW’ depictions

Pan-tastique upholds a very strict refund policy.

  • Refunds can only be given if the entire project was paid upfront, in which case, a maximum of 75% can be refunded.
  • No refunds shall be given for work that has already been done.
  • No refunds shall be given for work that has already been delivered.
  • The initial deposit is non-refundable in all cases.
  • The artist will only refund if the artist has made a mistake. In all cases, the artist will try to fix his mistake without the need for a refund.
  • Money lost due to currency conversion will not be reimbursed.

Regarding Commissions - merchandise

Generally, all purchases for merchandise will be made through this website or Etsy. Etsy has their own Terms of Service, please refer to those if making your purchase there.

All clients will agree to the following terms:

  • Payment for merchandise is made ahead.
  • The client pays for shipping and customs/import fees.
  • Convention commissions may be paid upfront through cash or card and will be shipped to the client’s home address.
  • All customers are charged in Euros. No other currency can be accepted at this time.
  • Design fee is included in the product price. 
  • The webshop on the site is for personal use only – please e-mail the artist if you wish to have something produced for commercial purposes.
  • No payment plans are available for purchases made through the site.

Due to Pan-tastique working with different manufacturers, production times for your product may vary. Pan-tastique can only give a guarantee for the artwork production phase.

As far as the artwork is concerned, Pan-tastique will stick to the given timeframe, but upholds the right to notify the customer of late delivery, given one of the following reasons applies:

  • Even if the client knows the third party, they must have permission from the third party for the artist to draw them if it’s a romantically inclined piece. 

Pan-tastique does not accept NSFW commissions for merchandise.

Pan-tastique accepts private merchandise commissions, subject to an extra fee.

Pan-tastique upholds a very strict refund policy.

  • The general rule of thumb is that in 99% of cases, your refund request for a custom item will be rejected.
  • No refunds shall be given for work that has already been done.
  • No refunds shall be given for work that has already been delivered.
  • The artist will only refund if the artist has made a mistake. In all cases, the artist will try to fix his mistake without the need for a refund.
  • Money lost due to currency conversion will not be reimbursed.

Regarding the Online Con Booth (my shop)

These ToS only apply to my own shop. Etsy has their own Terms of Service, please refer to those if making your purchase there.

All clients will agree to the following terms:

  • Payment for merchandise is made ahead.
  • The client pays for shipping and customs/import fees, unless stated otherwise.
  • All customers are charged in Euros. No other currency can be accepted at this time.
  • No payment plans are available for purchases made through the site.

Unless an item is listed as ‘out of stock’ or ‘backorder’ the client may assume it is ready to ship.

Currently, orders ship out once a week, generally Monday. Pan-tastique is not responsible for shipping delays.

Refunds should be requested within 30 days of receiving the product and be returned in original condition.

Pan-tastique withholds the right to decrease the refunded amount if the product is returned in damaged condition, unless the client has proof that the product was:

  • Delivered to the client in damaged condition
  • Left their hands in undamaged condition and was shipped back in either the original packaging or other means of secure packaging.

Refunds will be made by Pan-tastique within 5 days of receiving the item.

Items that cannot be returned (and will not be refunded if returned):

  • Charms that have the plastic protection peeled off.
  • Products not in original packaging, including pins and charms that have had their protective film removed.
  • Face masks.
  • Clothes that have been washed or worn (feel free to try them on of course!)
  • Items that are on clearance. The artist has good reason to choose not to restock these items.

Pan-tastique does not claim ownership of the characters depicted on his ‘fan art’ merchandise. Companies and rights holders are free to request a stop on the online sale of these items at any time, and Pan-tastique will honour their request.

Any merchandise listed with an ‘originals’ tag or ‘Swift Spark and the Defense Five’ tag falls under Pan-tastique’s copyright and may under no circumstance be resold or replicated.
